A judge says the state's plan for at-risk students is incomplete and orders more detail by March 26

If you follow public schools, here's where a big court case stands. A state judge ruled Monday that the Public Education Department's plan for at-risk students isn't comprehensive, as the court ordered last year. Judge Matthew Wilson turned down the plaintiffs' request to revise it themselves.

The Albuquerque Journal reports the order requires to file a supplement by March 26, 2027 that ties its corrective actions to prior rulings and shows how compliance can be measured.

PED's supplement is due after a change in governors

  1. 2014Parents and school districts file the Yazzie/Martinez case.
  2. 2018A landmark ruling finds the state violating students' rights.
  3. Nov. 2Judge Wilson rules 's plan is not comprehensive.
  4. Jan. 1Gov.-elect Deb Haaland is set to take over.
  5. March 2027PED must file its supplement to the plan.
  • Injunctions from 2019: 4, and the plan fully answers 2
  • Also due: a guide matching each action to its issue
  • Students covered by the 2018 ruling: around 70% of the state's
  • Plaintiffs' time to object: about a month

Melissa Candelaria, an attorney for the plaintiffs, said they appreciate the court agreeing PED hasn't complied but are disappointed it isn't requiring input from experts, families, school districts and tribes. Haaland said in a September interview that she believes the plan falls short and that she would bring the plaintiffs and tribes back to the table.
